1 Scope and provider
1.1. These General Terms and Conditions (hereinafter “Terms”) govern the contractual relationship between Squash-House Berlin 03 GmbH & Co. KG, Vulkanstraße 3, 10367 Berlin (hereinafter “Golftempel” or “Provider”), and you (hereinafter “Customer”), in the version valid at the time the contract is concluded.
1.2. Any conflicting terms and conditions of the Customer are rejected. Please read these terms carefully before using any of Golftempel's services.
1.3. At Golftempel we offer you the following services:
Indoor golf, golf coaching
2 Conclusion of the contract
2.1. Contracts on this portal can only be concluded in German.
2.2. The Customer must be at least 18 years old.
2.3. Access to the Golftempel service requires registration.
2.4. By registering, the Customer accepts these Terms. Registration creates a contractual relationship between Golftempel and the registered Customer, which is governed by these Terms.
2.5. The presentation of the service on the website does not constitute a legally binding offer. It merely invites the customer to make an offer.
2.6. By ordering a paid service, the registered Customer enters into a further contractual relationship with Golftempel, separate from the registration. Before this relationship is concluded, the user is informed about the paid service in question and the payment terms. The contractual relationship is formed when the Customer confirms the order and the obligation to pay by clicking the “Jetzt buchen” (Book now) button.
2.7. You agree to receive invoices electronically. Electronic invoices are made available to you by email or in the customer account on the website. For each service, we will inform you whether an electronic invoice is available. Further information on electronic invoices can be found on our website.
3 Description of services
Golftempel's services comprise the following:
You can book an indoor golf simulator here for private practice or for coaching with a coach.
4 Prices and shipping costs
4.1. Registration is required before using Golftempel.
4.2. To purchase services on the website, the user must register and create a user account.
4.3. If the user wishes to use a paid service, they will be informed beforehand that it is subject to a charge. In particular, the additional scope of services, the costs incurred and the payment method will be set out.
4.4. The Provider reserves the right to charge different pricing models for different booking times and user groups, and in particular for different periods of use, and to offer different scopes of service.
5 Terms of payment
5.1. Any fee due is payable to Golftempel in advance, on the due date, without deduction.
5.2. The Provider may exclude certain payment methods in individual cases.
5.3. The Customer may not pay for the service by sending cash or cheques.
5.4. If the Customer chooses an online payment method, the Customer thereby authorises the Provider to collect the amounts due at the time of the order.
5.5. If the Provider offers payment in advance and the Customer chooses this method, the Customer must transfer the invoice amount to the Provider's account within five calendar days of the order being received.
5.6. If the Provider offers payment by credit card and the Customer chooses this method, the Customer expressly authorises the Provider to collect the amounts due.
5.7. If the Provider offers payment by direct debit and the Customer chooses this method, the Customer grants the Provider a SEPA Core Direct Debit mandate. If a direct debit payment is returned due to insufficient funds or incorrectly provided bank details, the Customer shall bear the costs.
5.8. If the Customer defaults on payment, the Provider reserves the right to claim damages for the delay.
5.9. Payment can be made using the following methods:
– PayPal
– Credit card
– Gift card
– Direct debit:
In the event of a returned direct debit for which the Customer is responsible, Golftempel charges a flat-rate compensation of €5 (five euros). The Customer may prove that no damage was incurred or that it is substantially lower than the flat rate. The above provisions apply accordingly to payments of the purchase price of goods sold by third-party providers.
– Instant bank transfer (Sofortüberweisung)
– Payment in advance
6 Registration and termination
6.1. The Customer further declares that neither they nor, to their knowledge, any member of their household has a criminal record for an intentional offence endangering the safety of third parties, in particular for an offence against sexual self-determination (Sections 174 et seq. German Criminal Code, StGB), an offence against life (Sections 211 et seq. StGB), an offence against physical integrity (Sections 223 et seq. StGB), an offence against personal liberty (Sections 232 et seq. StGB), theft and embezzlement (Sections 242 et seq. StGB), robbery and extortion (Sections 249 et seq. StGB), or drug abuse.
6.2. A user account is for the user's sole and personal use, and a user may not authorise third parties to use it. A user may not transfer their account to third parties.
6.3. Subject to the above, a user may deregister at any time without giving reasons, in writing by email or by phone. Alternatively, the user can deactivate their account completely themselves in the account's data and settings. The previously concluded contractual relationship is thereby terminated.
6.4. If a user has booked a paid service, cancellation or rebooking is possible up to 24 hours before the booked appointment. Cancelling with a rebooking to a new date incurs no additional costs. Cancelling without rebooking incurs a cancellation fee of €10; the remaining amount will be refunded. If the cancellation is made less than 24 hours before the booked appointment, or if the user does not attend (no-show), the full payment is due and no refund is made. Refunds are processed within 14 days of cancellation.
6.5. Golftempel may terminate the contract at its own discretion at any time, with or without prior notice and without giving reasons. Golftempel further reserves the right to remove profiles and/or any content published on the website by or for the user. If Golftempel terminates the user's registration and/or removes the user's profiles or published content, Golftempel is under no obligation to inform the user of this or of the reason for the termination or removal.
6.6. Following any termination of an individual's use of Golftempel's services, Golftempel reserves the right to notify other registered users whom Golftempel believes to have been in contact with that user. Golftempel's decision to terminate a user's registration and/or to notify other users with whom Golftempel believes the user was in contact does not imply, and in no way states, that Golftempel is making any statement about the individual's character, general reputation, personal characteristics or lifestyle.
6.7. Users must not make any intentionally false or fraudulent statements in their profile or elsewhere on the portal. Such statements may result in civil action. In such a case, the operator also reserves the right to terminate the existing contractual relationship with immediate effect.
6.8. If a user's access is blocked and/or the contractual relationship is terminated because of a culpable breach of contract, the user shall pay damages for the remaining term of the contract in the amount of the agreed fee less the expenses saved. The expenses saved are set at a flat rate of 10% of the fee. Both parties remain free to prove that the damage and/or the expenses saved are in fact higher or lower.
6.9. After the contractual relationship ends, Golftempel deletes all of the user's data.
7 Limitation of liability (services)
7.1. Golftempel accepts no responsibility for the content and accuracy of the information in Customers' registration and profile data or any other content generated by Customers.
7.2. With regard to the service sought or offered, the contract is concluded exclusively between the Customers involved. Golftempel is therefore not liable for services provided by participating Customers. Accordingly, all matters concerning the relationship between Customers, including without exception the services received by a person seeking them or payments due to Customers, must be addressed directly to the party concerned. Golftempel cannot be held responsible for this and hereby expressly rejects all possible liability claims of any kind whatsoever, including claims, services, direct or indirect damage of any kind, known or unknown, suspected or unsuspected, disclosed or not, in any way connected with the matters mentioned.
7.3. Golftempel is only liable for damage resulting from injury to life, body or health if it is based on an intentional or negligent breach of duty by Golftempel or by a legal representative or vicarious agent of Golftempel.
7.4. For other damage, unless it results from a breach of cardinal obligations (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance the contracting party may regularly rely), Golftempel Europe is only liable if it is based on an intentional or grossly negligent breach of duty by Golftempel or by a legal representative or vicarious agent of Golftempel.
7.5. Claims for damages are limited to the foreseeable damage typical for this type of contract. In the event of delay, they amount to a maximum of 5% of the order value.
7.6. Claims for damages based on injury to life, body, health or liberty become time-barred after 30 years; all other claims after 1 year, with the limitation period beginning at the end of the year in which the claim arose and the creditor became aware, or should have become aware without gross negligence, of the circumstances giving rise to the claim and of the identity of the debtor (Section 199(1) German Civil Code, BGB).
7.7. The Provider reserves the right to check the content of texts written and files uploaded by a user for compliance with the law and, if necessary, to delete them in whole or in part.
8 Set-off and right of retention
8.1. The Customer is only entitled to set-off if the Customer's counterclaim has been legally established or is undisputed by the Provider.
8.2. The Customer may only exercise a right of retention insofar as their counterclaim is based on the same contractual relationship.
10 Data protection
10.1. If personal data (e.g. name, address, email address) is collected, we undertake to obtain your prior consent. We undertake not to pass on any data to third parties unless you have consented beforehand.
10.2. Please note that data transmission over the internet (e.g. by email) may have security gaps. Complete, error-free protection of data against access by third parties therefore cannot be guaranteed. Our liability in this respect is excluded.
10.3. Third parties are not entitled to use contact details for commercial purposes insofar as the Provider has previously given the persons concerned written consent.
10.4. You have the right at any time to receive complete information, free of charge, from Golftempel about the data stored about you.
10.5. The user also has the right to rectification or erasure of data and to restriction of processing.
11 Cookies
11.1. We may use cookies to display our range of services. Cookies are small text files that are stored locally in the cache of the visitor's web browser.
11.2. Many websites and servers use cookies. Many cookies contain a so-called cookie ID, a unique identifier of the cookie. It consists of a character string through which websites and servers can be assigned to the specific web browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the data subject from other web browsers that contain other cookies. A specific web browser can be recognised and identified by its unique cookie ID.
11.3. Using cookies allows us to provide users of this website with more user-friendly services that would not be possible without them.
11.4. Please note that some of these cookies are transferred from our server to your computer system; most of them are so-called session cookies. Session cookies are automatically deleted from your hard drive at the end of the browser session. Other cookies remain on your computer system and allow us to recognise it on your next visit (so-called persistent cookies).
11.5. You can object to the storage of cookies; a banner is available for this purpose, in which you can decline or accept.
11.6. You can, of course, set your browser so that no cookies are stored on your hard drive, or so that cookies already stored are deleted. Instructions on preventing and deleting cookies can be found in the help function of your browser or software manufacturer.
12 Place of jurisdiction and applicable law
12.1. Disagreements and disputes arising from this contract are governed exclusively by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
12.2. The sole place of jurisdiction for orders by merchants, legal entities under public law or special funds under public law is the Provider's registered office.

By concluding the contract, you agree to our house rules.

14 Final provisions
14.1. The language of the contract is German.
14.2. We do not offer products or services for purchase by minors. Our products for children can only be purchased by adults. If you are under 18, you may only use Golftempel with the involvement of a parent or legal guardian.
14.3. If you breach these Terms and we take no action, we remain entitled to exercise our rights on any other occasion on which you breach these terms of sale.
14.4. We reserve the right to make changes to our website, policies and terms, including these Terms, at any time.
